JAMES F. PICO

Medical Malpractice, Complex Product Liability, Insurance Defense

A native Las Vegan, Jim Pico received his Bachelor of Science from Loyola University of Los Angeles, served in the Air Force, and in 1963 received his LLB/J.D. from the University of San Francisco School of Law. Named in the Best Lawyers in America and AV rated with Martindale-Hubbell, he is a member of the Nevada, Clark County, California, and American Bar Associations and has served as President of the Clark County Bar Association and on the Board of Governors for the Nevada State Bar.

Mr. Pico handles some of the most difficult insurance defense cases in Nevada in the areas of medical malpractice, complex product liability, and has handled aircraft and mass disaster cases such as the MGM fire litigation and Pepcon explosion cases.

JAMES R. ROSENBERGER

Jim Rosenberger has an AV rating with Martindale-Hubbell and has lived in Las Vegas since 1968. A member of the Nevada Bar since 1981, Mr. Rosenberger has tried more than 60 jury trials to verdict, and has extensive experience in appellate practice before the Nevada Supreme Court and the United States Court of Appeals for the Ninth Circuit. Mr. Rosenberger’s experience includes representation before various political, administrative, and professional boards throughout the State of Nevada.

Mr. Rosenberger has been involved at the trial and appellate level in numerous seminal cases in Nevada Law including, but not limited to, Gilloon v. Humana, Inc., 687 P.2d 80 (1984) the medical malpractice wrongful death statute of limitations; M & R Investment Co. v. Goldsberry, 707 P.2d 1143 (1985) employment law - wrongful termination and interference with prospective contractual relations; Fire Insurance Exchange v. Zenith Radio, 747 P.2d 911 (1987) spoliation of evidence requiring dismissal of product liability claim; Russo v. Circus Circus Enterprises, Nevada Supreme Court Case No. 20393 - bad faith discharge of employee and discrimination on basis of physical impairment; Ashokan v. Eighth Judicial District Court, 856 P.2d 244 (1993) statutory “peer review” privilege for physicians in malpractice proceedings; Prabhu v. Levine, 855 p.2d 543 (1993) and 930 P.2d 103 (1996) standard for “lost chance” malpractice claims in Nevada; Yamaha Motor Co. V. Arnoult, 955 P.2d 661 (1998) causation standard in products liability action and adequacy of warnings in owners manual; Dictor v. Creative Management Services 223 P.3d 332 (2010) application of Missouri law to affirm Summary Judgment in complex coverage case; Lawyer’s Title of Nevada, Inc. a Nevada corporation v Karl Bonar, et al. unpublished decision number 56309 (2012) order affirming judgment in excess of $200,000.00 against Lawyer’s Title of Nevada based upon fraud and breach of fiduciary duties; among others.

A member of the American Bar Association, the Defense Research Institute and The Million Dollar Advocates Forum. Mr. Rosenberger’s practice has focused on the defense of catastrophic injury, products liability, property damage, employment claims, and professional malpractice claims. Among his clients are numerous physicians, product manufacturers, employers, hotels and national businesses. Mr. Rosenberger is the State of Nevada Liaison to the Medical Liability and Health Care Law Committee of the Defense Research Institute.
